Terms of Service

These Terms of Service ("Terms") govern your access to and use of FoodPicAI ("Service"), operated by FoodPicAI ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms. Please read them.

1. Eligibility

You must be at least 18 years old to use FoodPicAI. By using the Service, you confirm that you are 18 or older and that you operate or represent a food business, restaurant, or related commercial entity. The Service is intended for commercial use by food and hospitality businesses.

2. Account Registration & Security

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must notify us immediately at [email protected] of any unauthorized use of your account. We are not liable for losses caused by unauthorized account access.

3. Service Description

FoodPicAI provides AI-powered food photo enhancement. You upload a photo of food; our system uses Google's Gemini AI to apply professional lighting, color grading, and background adjustments; you download the enhanced image. The AI enhances your existing photo — it does not generate, add, or remove food items.

We reserve the right to modify, suspend, or discontinue any part of the Service with reasonable notice.

4. Acceptable Use

You agree not to use the Service to:

• Upload illegal content, including images involving minors or content that violates any applicable law
• Create or distribute misleading food imagery intended to deceive customers about a food product's appearance or quality
• Attempt to reverse-engineer, copy, or resell the Service or its underlying technology
• Circumvent rate limits, access controls, or payment requirements
• Upload content to which you do not hold the rights

Violation of these rules may result in immediate account suspension without refund.

5. Payment Terms

All payments are processed securely by Stripe. Subscriptions renew automatically on your billing date. You authorize us to charge your payment method on each renewal date. Prices are in USD and may be subject to applicable taxes.

6. Refund Policy

To request a refund for exceptional circumstances, contact [email protected] within 7 days of the charge. Refunds are granted at our sole discretion.

7. Cancellation

You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you retain access and any remaining credits until that date. We do not charge cancellation fees.

8. Intellectual Property

Your content: You own your uploaded photos and all enhanced images produced from them. By uploading, you grant us a temporary, limited license to process the image solely to perform the enhancement. This license expires when processing is complete and the image is deleted.

Our content: FoodPicAI, its software, prompts, UI, brand, and methodology are owned by us and protected by intellectual property law. You may not copy, resell, or create derivative works of the Service itself.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that the AI enhancement results will meet your specific expectations. AI-enhanced food photography is a visual tool only and is not a substitute for professional food safety compliance, nutritional labelling, or regulatory requirements.

10. Limitation of Liability

To the maximum extent permitted by law, FoodPicAI's total liability to you for any claim arising from these Terms or use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim. We are not liable for any indirect, incidental, special, or consequential damages, including lost profits or data loss.

11. Indemnification

You agree to indemnify and hold FoodPicAI harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your content, or your violation of these Terms.

12. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of law principles. Any disputes will be resolved in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

Before filing a formal claim, you agree to contact us at [email protected] and attempt to resolve the dispute informally for at least 30 days.

13. Changes to These Terms

We may update these Terms from time to time. If changes are material, we will notify you by email at least 30 days before they take effect. Continued use of the Service after that date constitutes acceptance of the new Terms. The "Last updated" date at the top reflects the current version.
